In general, only a child's biological parents can file a custody complaint and seek custody rights with regard to their minor child. In very limited circumstances, third parties are granted the right to seek partial or primary custody of a minor child. "Physical custody" is the actual physical possession and control of a minor child. A party may have sole physical custody, primary physical custody, partial physical custody, shared physical custody or visitation rights. "Legal custody" is the right to make important decisions that impact the minor child including decisions regarding education, religion and medical care. The standard for determining custody of a minor child(ren) in Pennsylvania is what is in the "best interests" of the child(ren). |
