DIVORCE & SEPARATION
Pennsylvania is a "no-fault" divorce state. The term "no-fault" means that a divorce may be obtained without regard to marital fault. There are two ways to obtain a no-fault divorce in Pennsylvania:

(1) If both parties consent to a divorce and (a) one of the parties files a complaint for divorce alleging the marriage is irretrievably broken; (b) at least ninety (90) days has elapsed from the date of the filing of the complaint; and (c) each party files an affidavit consenting to the entry of a divorce decree.

(2) If one party does not consent to a divorce, the court may grant a divorce at the request of the party seeking the divorce where s/he can prove that the parties have lived separate and apart from one another, even within the same residence, for more than two (2) years and that the marriage is irretrievably broken.
