Mediation is the process where disputants have the opportunity to listen to and talk with each other, share information, consider each other's perspectives, and make voluntary informed decisions, with the assistance and support of an impartial mediator. The mediator does not make decisions for the parties and does not provide legal advice or representation. Parties are encouraged to consult with an attorney for any legal information and advice which may aid them in making their decisions. At the conclusion of the mediation process, if the parties want, the mediator will prepare a summary of the decisions they have reached and if they want the summary to become a legally binding agreement, they must have an attorney draft a formal agreement. |
