Tenancy by the entireties is a method of ownership of property available only to a married couple. A tenancy by the entireties is presumed to have been established where the grantees of certain property are actually husband and wife. Property owned as tenants by the entireties is protected from creditors of one of the spouses, even where one spouse was the guarantor of the debtor spouse. Only joint debts expose entireties property to execution by creditors.
When a divorce decree is entered a tenancy by the entirety is converted to a tenancy in common. Once this occurs a partition action is available to either of the tenants in common.
